TERMS AND CONDITIONS OF CONTRACT
These terms and conditions (‘Terms and Conditions’) apply to the sale to you by Watling Street Galleries of any print, piece of original artwork, sculpture or gift, by any artist either at Watling Street Galleries’ premises or through its website.
We go to great lengths to photograph and represent our products in a true light on our website. Their colours, scale and specification stated are designed to give you the best possible interpretation of the article you are purchasing, but what you see is very much dependant on the quality and settings of the computer monitor or device you use to view them. Therefore we are not liable for any discrepancies that might occur in this respect.
Love Art Purchase Scheme
The minimum purchase price is £200.00. A 20% deposit is required to start the scheme. Four consecutive monthly payments will commence at the end of the following month via Credit/Debit Card. This may be paid over the phone or instore. Don’t worry, we shall remind you once these are due. Goods are held at, and remain the property of Watling Street Galleries until paid in full. The monthly repayments are refundable if you change your mind within the term. The deposit is strictly non refundable after a 14 day cooling off period. The balance may be settled at any time within the term, which means you can start enjoying your art earlier.
Orders and Prices
In respect of an order for Gift Vouchers made through the Watling Street Galleries’ website, the maximum order quantity is only limited by stock levels or availability. Select the number of items you wish to buy, then click on checkout and enter your personal details onto the form. Your order will then be processed by our system. You can also order by telephone on 01327 351595 or by visiting us. You will be kept informed throughout the order procedure via email.
Artwork prices are subject to change. Prices may rise as an edition of an Artwork begins to sell out. All prices are subject to VAT which is included in the displayed price.
We are pleased to inform you that, at present, Gift Vouchers purchased directly through the checkout on our website have a FREE 2 WORKING DAY UK DELIVERY. These may also be ordered online for a same day collection. You may request a faster delivery service by contacting us. This will incur an additional shipping charge. Price on application.
The exceptions to the ‘Free UK Delivery’ are items which are labeled ‘Available to purchase instore’ and are not available for purchase through the shopping cart. These may only be purchased instore or by phoning us on (01327 351595). They may then either be COLLECTED in person, or DELIVERED FREE within the (NN12) postcode area. In this case the value of the purchase must be £200.00 or more to qualify for this delivery service.
We do however reserve the right to change our delivery terms at any time.
Watling Street Galleries provides an efficient despatch service. All orders are sent from the UK using Royal Mail, or courier services. All items will require a signature on arrival as proof of delivery.
Our Gift Vouchers are dispatched Monday to Friday and we aim to deliver within 2 days. If your order is delayed by more than 2 days we will inform you of the expected dispatch date via email. You can then choose to either wait a little longer for delivery, accept a refund or pick an alternative item from our stock. Watling Street Galleries is not liable for any loss incurred what so ever if goods do not arrive on time.
By ticking the Terms and Conditions box, you confirm that you are aware of and consent to the use by the Watling Street Galleries of any personal data within the meaning of the Data Protection Act 1998 and that Watling Street Galleries may create and maintain computer and paper records, collect, hold, control, use and transmit personally identifiable information obtained from you in the course of the purchase of the goods.
By agreeing to these Terms and Conditions you consent that such personal data may be used for promotions connected with Watling Street Galleries but NOT shared with any third parties.
Liability of Watling Street Galleries
Except in respect of death or personal injury caused by Watling Street Galleries’ negligence, Watling Street Galleries shall not be liable to you by reason of any representation (unless fraudulent), or any implied warranty, condition or other term, or any duty at common law, for any loss of profit or any indirect special or consequential loss, damage, costs, expenses or other claims (whether caused by the negligence of Watling Street Galleries, its employees, agents, sub-contractors or otherwise) which arise out of or in connection with the sale of the Goods or its use by you and the entire liability of Watling Street Galleries under or in connection with the sale of the Goods to you shall not exceed the total sum paid under the invoice for the Goods.
Watling Street Galleries does not accept any liability for damage to goods caused by your own negligence or fault, in particular, but not restricted to, in the maintenance of the Goods.
In accordance with the European Distance Selling Directive, Watling Street Galleries will supply you with a contract for each purchase you make on the site. You have the right to withdraw from the contract, within seven working days from receipt of the goods, and return the Goods without having to give any reason. If you withdraw you will be reimbursed by the same method with which you paid, within thirty days.
It will totally be your responsibility to pay postage & adequate insurance of returning the goods. This is not refundable, yet we do not add an administration or repackaging charge. Under these conditions, returned goods must reach us in 100% re-saleable condition for customers to be eligible for a refund. We would recommend the item is adequately wrapped using the original packaging materials with the addition of further wrapping if required.
Our bespoke returns policy
If you order a bespoke item on our website or instore, including choosing a custom Canvas Print option, or a Bespoke Framing order, these items are made-to-order and therefore the right to withdraw from the contract within seven working days under the European Distance Selling Directive is not applicable. This right is also not applicable to any other made-to-order (bespoke) item. Any Purchase, or Bespoke Order remains the property of Watling Street Galleries until paid in full.
